Vehicular Homicide Charges in Oregon
When reckless or negligent driving behavior results in a death, the driver could be charged with one of three felony crimes:
Manslaughter in the first degree — A Medida 11 offense. Conviction carries a mandatory 10-year prison sentence with no chance of parole. To obtain a conviction, the state must show that the driver acted recklessly with extreme indifference to human life.
Manslaughter in the second degree — A Measure 11 offense. Conviction carries a mandatory 75-month prison sentence with no chance of parole. The state must show that the driver acted recklessly.
Criminally negligent homicide — There is no mandatory sentence. The state must show that the person acted negligently.
