When reckless or negligent driving behavior results in a death, the driver could be charged with one of three felony crimes:
Manslaughter in the first degree — A Measure 11 offense. Conviction carries a mandatory 10-year prison sentence with no chance of parole. To obtain a conviction, the state must show that the driver acted recklessly with extreme indifference to human life.
Manslaughter in the second degree — A Measure 11 offense. Conviction carries a mandatory 75-month prison sentence with no chance of parole. The state must show that the driver acted recklessly.
Criminally negligent homicide — There is no mandatory sentence. The state must show that the person acted negligently.
Keep in mind that the state must prove its case beyond a reasonable doubt. Our job is to make that as difficult for the prosecution as we can. When representing you, we will carefully examine every aspect of your case, looking for a way to defeat the state's case or reduce the charge.
Circumstances may be such that the accident was the other driver's fault, not yours. Our firm retains the services of accident reconstruction professionals, road safety experts and other professionals to determine how accidents happen and who was responsible. Gilroy Napoli Short Law Group will do everything we can to obtain a positive outcome for you.
