Getting You Name Removed From the Sex Offender Registry in Oregon

For many sex crime charges, conviction results in mandatory listing on the Oregon sex offender registry. This is a publicly available list that can restrict a person’s employment and residence options, and requires the person to report any changes in place of residency. Listing on the sex offender registry can continue to haunt a person long after he has paid his debt to society.

In Oregon, sex offender registry removal is possible in certain cases. Other people may be able to avoid getting listed in the first place. Getting relief, however, presents challenges and is by no means certain. The services of an experienced criminal defense attorney can prove invaluable in this effort.

Your Options Regarding the Oregon Sex Offender Registry

Depending on circumstances, it may be possible to get your name removed from the sex offender list or avoid a listing altogether, as described below.

Petition for removal — Under Oregon ORS 181.820, a person who has been convicted of one Class C felony or misdemeanor sex crime can apply for removal from the registry after 10 years. Before granting such relief, the court will carefully examine the person’s history since the conviction and factors related to the crime itself, such as the level of violence and the age of the victim. The court will hold you to a high standard, so your petition must be skillfully prepared and argued.

Juveniles — Juveniles who have been adjudicated of a misdemeanor sex crime that would ordinarily result in registration as an adult, no longer have to register. Those adjudicated for a Class C felony sex crime may petition for relief 30 days after discharge, or release from probation, parole or incarceration. Those adjudicated for Class A and Class B felony sex crimes can petition for relief two years after discharge, or release from probation, parole or incarceration.

Plea bargain — Though it can be a bitter pill to swallow, it may be preferable to seek an outcome that results in a felony conviction without registration rather than a misdemeanor conviction that requires registration. A lawyer at Gilroy Napoli Short Law Group can review your situation and discuss the pros and cons of this approach.

Aggressive defense at trial — This may be the best option for some people charged with sex offenses. As experienced trial lawyers, we will vigorously defend you, seeking a dismissal of charges, a not-guilty verdict or another acceptable outcome.

I had the misfortune of being wrongfully accused of a crime. Like many other people, I looked to other's experiences along with online reviews for direction on who to have represent me. I quickly recognized how highly respected and experienced Mr. Jeff Napoli and his team were as they have earned a solid reputation throughout the Portland metro area. Mr. Napoli was always prompt in responding and communicating with me. Mr. Napoli went above and beyond in repeatedly contacting the district attorney's office on my behalf and equally kept me apprised of what was transpiring. Throughout this ordeal, I was also represented by Ms. Jenna Richards, a member of Mr. Napoli's team. My family and I were highly impressed. Both Jeff and Jenna conducted a thorough counter-investigation which clearly proved I was innocent of the charges against me. This was one of the most stressful periods in my life and I could not thank them enough for all of the help, attention and respect they showed me throughout this entire year-long ordeal. I highly recommend Gilroy, Napoli and Short law firm to anyone seeking top tier representation. Thank you Jeff, Jenna and their entire team!

It was 2022 and I thought I had lost my future. Due to careless due diligence, I made some seriously stupid decisions and ended up in a criminal defense case. This was my first legal experience and I had never been more emotionally distraught in my life. Thankfully, I made the right decision in having Tucker Rossetto as my attorney. The penalties could've been much worse, but he got it down to less than I thought it would be. From felony to misdemeanor. It was reassuring to know that there was light at the end of the tunnel. Thank you for everything!
